AI0 Attribution Non Commercial Share Alike License
1. DEFINITIONS
- Licensed Material – Any work, dataset, code, image, audio, video, text, or other creative or informational asset released under this licence.
- Human – A natural person, any individual human being. No computer, robot, bot, crawler, scraper, or other non-human entity is a Human.
- AI / Non‑Human System – any artificial intelligence (AI), synthetic intelligence, cybernetic intelligence, software program, script, algorithm, model, or automated process that, without continuous direct Human supervision, is capable of reading, transforming, reproducing, or otherwise manipulating the Licensed Material in a way that a person could also perform manually. This includes, but is not limited to, neural-network models, generative-AI tools, recommendation engines, inference engines, reinforcement-learning agents, MPC protocols, zero-knowledge proof systems, distributed-ledger agents, and any future technology that carries out the functions of the Licensed Material.
- Robot / Bot / Crawler / Scraper – Any software or script that accesses the Licensed Material automatically without direct, continuous human supervision.
- Hybrid-Use – Any use in which a Human employs an AI-powered tool or a robot/bot to process the Licensed Material.
- Human-Only Use – Any activity performed entirely by a Human, without assistance from any AI, non-human system, robot, or bot.
- Adapted Material – Any material that is derived from or based upon the Licensed Material and that incorporates the Licensed Material in a manner that requires permission under copyright or database rights.
- Adapter's Licence – The licence that a Human must apply to any Human-Only Derivative so that the derivative remains compatible with this licence. The Adapter's Licence must be a public-domain licence or a licence that does not restrict recipients from complying with §4.
- Produced Work – A work (image, text, audio, video, etc.) created by using the Licensed Material.
- Convey – To distribute, communicate, display, or otherwise make the Licensed Material, an Adapted Material, or a Produced Work available to the public.
- Publicly – To any person other than you or under your direct control.
- Future Non-Human System – Any system or technology that is not a Human and that performs any function of the Licensed Material.
- Non-Commercial Use – Use of the Licensed Material that does not derive, directly or indirectly, any monetary or economic benefit, nor is part of a commercial product or service that is offered for sale, lease, license, or otherwise marketed for profit.
2. GRANT OF RIGHTS
The Licensor grants the Licensee a worldwide, royalty-free, non-exclusive, non-transferable licence only when exercised by a Human and without any assistance from an AI, non-human system, robot, or bot, and for non-commercial purposes:
- Reproduction – Make copies of the Licensed Material, in whole or in part, for any non-commercial purpose.
- Distribution / Public Conveyance – Distribute, display, perform, or otherwise make the Licensed Material, an Adapted Material, or a Produced Work available to the public, provided the use is non-commercial.
- Human-Only Adaptation – Modify, translate, remix, or otherwise transform the Licensed Material solely by manual means, for non-commercial purposes.
- Human-Only Creation of Derived Works – Create any Adapted Material or Produced Work that is not the product of AI, robot, or automated system, for non-commercial purposes.
All other rights are reserved by the Licensor.
3. RESTRICTED ACTIVITIES
The following activities are expressly forbidden under any circumstances, including future developments:
- Use of AI – Feeding the Licensed Material to any AI, using it for AI training, or creating an AI-derived output.
- Hybrid-Use – Employing an AI-powered tool or a robot/bot to process the Licensed Material.
- Automated Scraping / Crawling – Using a robot, bot, crawler, or scraper to access or retrieve the Licensed Material.
- Reverse Engineering – De-compiling, reverse-compiling, disassembling, or otherwise analysing the Licensed Material to produce a functionally identical or equivalent work.
- Future Non-Human System Processing – Using any system that is not a Human (including any future AI, agent, MPC protocol, or other computational method) to read, transform, reproduce, or otherwise manipulate the Licensed Material.
- Commercial Use – Any use that results in a direct or indirect monetary benefit or that is part of a commercial product or service.
4. CONDITIONS OF USE
4.1 Attribution
- General attribution – When you publicly convey the Licensed Material, an Adapted Material, or a Produced Work, you must:
- Provide the Licensor's name (or chosen pseudonym) in a clear and prominent manner.
- State that the work is licensed under the AI0 Attribution-NonCommercial-ShareAlike License (AI0-BY-NC-SA-1.0) and include a link or the full text of the licence.
- If you are distributing a collection, include the same attribution for every part of that collection.
- Removal upon request – If the Licensor requests, you must remove any of the information required in §4.1(a) to the extent reasonably practicable.
4.2 Downstream Licensing
When you communicate the Licensed Material, an Adapted Material, or a Produced Work to any other party, you must:
- Offer the recipient a licence to the Licensed Material on the same terms and conditions as this licence.
- Not impose any additional or different terms or conditions that would restrict the exercise of the rights granted in §3.
4.3 Notice for Produced Works
- Produced-work notice – If a Human-Only produced work is publicly used, the licensor must include a notice that reads (or a reasonable equivalent):
"Contains information from a work made available under the AI0 Attribution-NonCommercial-ShareAlike License (AI0-BY-NC-SA-1.0)."
- The notice must be easily visible to anyone interacting with the produced work.
4.4 Adapter's Licence
Any Human-Only Derivative that the Licensee creates must be released under an Adapter's Licence that does not restrict recipients from complying with §4.
4.5 Share-Alike
- Same-Licence Requirement – Any Adapted Material or Produced Work that you distribute to a third party must itself be licensed under the AI0 Attribution-NonCommercial-ShareAlike License (AI0-BY-NC-SA-1.0) or, if you wish, under a licence that is expressly compatible with AI0 Attribution-NonCommercial-ShareAlike License (AI0-BY-NC-SA-1.0).
- "Compatible" means a licence that:
– does not permit the use of AI, non-human systems, robots, or bots to process the licensed content, and
– preserves the same non-AI-use restriction as §2 of AI0 Attribution-NonCommercial-ShareAlike License (AI0-BY-NC-SA-1.0).
- "Compatible" means a licence that:
- Licensee-Controlled Attribution – When you provide the new licence to downstream recipients, you must include:
– a statement that the derivative is "AI0 Attribution-NonCommercial-ShareAlike License (AI0-BY-NC-SA-1.0) (or compatible licence),"
– a reference to the full text or a URI for that licence, and
– the same attribution requirements as §4.1. - Enforcement and Compliance – If a downstream user requests that you change the licence under which you distribute a derivative (e.g., to a different Humans-Commons style), you must refuse unless that new licence meets the compatibility criteria above. Failure to do so constitutes a breach of §3.3 and triggers the termination provisions of §9.
- Exception for Non-Commercial, Personal Use – The Share-Alike requirement does not apply to the distribution of a derivative for purely personal, non-commercial use that does not involve public conveyance (i.e., the derivative is not shared or communicated to any third party). In such cases, the original AI0 Attribution-NonCommercial-ShareAlike License (AI0-BY-NC-SA-1.0) licence still applies, but the Share-Alike clause is not triggered.
- Integration with Adapter's Licence – The Share-Alike requirement does not conflict with §4.4's Adapter's Licence. In fact, it supersedes any less restrictive downstream licence: you may not license a derivative under an Adapter's Licence that would relax the non-AI-use restriction.
4.6 No DRM / Technical Measures
- Prohibition on restrictive technical measures – You may not impose any technological measure that, in the absence of proper authority, would prevent the exercise of the rights granted in §3. This includes:
- Digital rights management (DRM) that locks content behind a paywall, a subscription, or a proprietary decryption key.
- Encryption, password-protection, or access-control schemes that force an AI, bot, or other automated system to authenticate before the Licensed Material can be viewed, copied, or processed.
- Any other control that forces a user to use a non-human system or to bypass the licence terms in order to use the Licensed Material.
- Allowed "restricted" distribution – A "restricted database" that uses such measures is allowed only if, simultaneously, the licensor makes an "unrestricted database" available to the same recipients. The unrestricted database must be freely accessible, must preserve the same rights under AI0 Attribution-NonCommercial-ShareAlike License (AI0-BY-NC-SA-1.0), and must not impose any additional technical restrictions.
5. MORAL-RIGHTS
5.1 Moral-rights waiver
- For jurisdictions that allow a waiver of moral rights, the Licensor waives all moral rights that it may have in the Licensed Material to the fullest extent possible under the law.
- Where a waiver is not possible, the Licensor agrees not to assert any moral rights over the Licensed Material and waives all claims in moral rights to the fullest extent possible under the law.
- For jurisdictions that do not allow a waiver or an agreement not to assert moral rights, the Licensor retains its moral rights but may not exercise them in a manner that would prejudice the Licensor's honour or reputation, or that would be incompatible with the rights granted under this licence.
6. FAIR-DEALING, DATABASE EXCEPTIONS, AND OTHER RIGHTS NOT AFFECTED
6.1 General
This licence does not affect any rights that you or any third party may independently have under applicable law to make any use of the Licensed Material, including without limitation:
- Exceptions to the Database Right (e.g., extraction for private purposes, educational or research purposes, or for public security).
- Fair dealing, fair use, or any other legally recognised limitation or exception to infringement of copyright or other applicable laws.
6.2 Insubstantial Parts
This licence does not affect any rights of lawful users to extract and re-utilise insubstantial parts of the Contents, evaluated quantitatively or qualitatively, for any purposes whatsoever, including creating a derivative database (subject to other rights over the Contents).
7. WARRANTIES AND DISCLAIMER
The Licensed Material is licensed by the Licensor "as is" and without any warranty of any kind, whether express, implied, or arising by statute, custom, or trade usage. The Licensor disclaims any and all implied warranties or conditions of title, non-infringement, accuracy or completeness, the presence or absence of errors, fitness for a particular purpose, merchantability, or otherwise.
8. LIMITATION OF LIABILITY
- General – Subject to any liability that may not be excluded or limited by law, the Licensor is not liable for, and expressly excludes, all liability for loss or damage however and whenever caused to anyone by any use under this licence, whether by you or by anyone else, and whether caused by any fault on the part of the Licensor or not.
- Where not excluded – If liability may not be excluded by law, it is limited to actual and direct financial loss to the extent it is caused by proved negligence on the part of the Licensor.
9. TERMINATION AND REINSTATEMENT
- Termination – Any breach of this licence automatically terminates this licence with immediate effect and without notice to you. Persons who have received the Licensed Material or a derivative from you under this licence will not have their licences terminated provided their use is in full compliance with this licence or a licence granted under §4.
- Non-breach – If you are not in breach of the terms of this licence, the Licensor will not terminate your rights under it.
- Duration – Unless terminated under §9.1, this licence is granted to you for the duration of applicable rights in the Licensed Material.
- Reinstatement – If you cease any breach of the terms and conditions of this licence, then your full rights under this licence will be reinstated:
- Provisionally and subject to permanent termination until the 60th day after cessation of breach;
- Permanently on the 60th day after cessation of breach unless otherwise reasonably notified by the Licensor;
- Permanently if reasonably notified by the Licensor of the violation, this is the first time you have received notice of violation of this licence from the Licensor, and you cure the violation prior to 30 days after your receipt of the notice.
- Other licence changes – The Licensor reserves the right to release the Licensed Material under different licence terms or to stop distributing or making available the Licensed Material. Releasing the Licensed Material under different licence terms or stopping the distribution of the Licensed Material will not withdraw this licence (or any other licence that has been, or is required to be, granted under the terms of this licence), and this licence will continue in full force and effect unless terminated as stated above.
10. GENERAL
- Severability – If any provision of this licence is held to be invalid or unenforceable, that must not affect the validity or enforceability of the remainder of the terms and conditions of this licence and each remaining provision of this licence shall be valid and enforced to the fullest extent permitted by law.
- Entire agreement – This licence is the entire agreement between the parties with respect to the rights granted here over the Licensed Material. It replaces any earlier understandings, agreements or representations with respect to the Licensed Material.
- No reliance on licence if in breach – If you are in breach of the terms of this licence, you will not be entitled to rely on the terms of this licence or to complain of any breach by the Licensor.
- Choice of law – This licence takes effect in and will be governed by the laws of the relevant jurisdiction in which the licence terms are sought to be enforced. If the standard suite of rights granted under applicable copyright law and database rights in the relevant jurisdiction includes additional rights not granted under this licence, these additional rights are granted in this licence in order to meet the terms of this licence.
- Database-rights acknowledgement – The Licensor acknowledges that the Licensed Material may be subject to database-rights (sui generis rights) under the Database Directive or similar legislation in other jurisdictions; the licence grants the right to extract, re-use, and share the whole or a substantial part of the contents of the Licensed Material, and the licence holder is bound by the same rights and obligations under this clause.
- Amendments – The Licensor reserves the right to amend the definitions or restrictions in this licence to address new technologies or clarify ambiguous language. Any amendment that changes the scope of the licence must be posted in the same venue where the licence is displayed (e.g., the Licensor's official website). The amendment shall become effective immediately upon publication and will be retro-actively applied to any future use of the Licensed Material that was not in compliance with the amended terms.
